I talked to LaMigra tonight for a little while and he said there were 2 deaths and almost a 3rd. A 20 year old girl was in a Rhino strapped in with doors on it and it flipped into a water hole. They couldn't get her out in time and she drowned. He didn't say if alcohol was a factor or not. I know he went down Thursday morning and left Saturday morning. He said he had had enough buy the time Saturday got there. He said way to many people and way to many idiots. He also said they didn't enforce one rule that they put in place for safety.

Again, any death of a 20-year-old deserves compassion and condolences for family and loved ones.

And, ATV deaths detract from the public image of the activity.

In my opinion, the Mud Nationals deaths won't deter the crowds or lessen the take from the gate--the assumed proximity to danger may even make the event more alluring to some customers.

I'd expect only a mega-lawsuit for negligence would change policies and practices at the Mud Nationals.

Regarding the first fatal ATV accident at this year's Mud Nationals, from TylerPaper.com:

Man Dies At Mud Nationals
By KELLY PREW
Staff Writer

JACKSONVILLE - A weekend of off-road fun became deadly Thursday afternoon when a 32-year-old died as the result of an all-terrain vehicle accident at the Mud Nationals.

Samuel Shane Howard, of Batesville, Miss., was riding his four-wheeler about 4:45 p.m. when a witness said he ran off a trail in the Mud Creek Off-Road Park where the nationals are being held, according to information from the Cherokee County Sheriff's Office.

Howard's four-wheeler overturned and landed on top of him.

Detective Capt. Chris White told the Tyler Paper that witnesses said it looked as though Howard was attempting to maneuver a bump in the trail when his tire caught, sending the ATV into several rolls.

"It's the type of accident that could happen to anybody," White said. "He wasn't riding his (ATV) in a manner different than anyone else."

He said the park does not designate lanes of traffic, nor does it implement speed limits for ATVs.

Emergency services personnel from the park and from East Texas Medical Center responded, and reports from Justice of the Peace Vera Forman said the victim apparently died instantly. Ms. Forman pronounced the victim dead and ordered the body be taken to Southeast Forensics in Tyler for autopsy.

White said he did not believe alcohol or the weather were factors in the accident.

He said the park allows no drinking and driving, which is enforced by on-site security guards.

The ATV Mud Nationals official Web site outlines attendance and alcohol policies.

White said this is the first fatality to come from the event, now in its sixth year.

The event began Wednesday and will run through Sunday.

There have been no plans, according to the sheriff's office or the nationals' organizers, to close the park.

However, White said the trail where the accident occurred was closed off during the initial investigation, but now is open.

ATV Mud Nationals could host more than 10,000 enthusiasts and vendors over the weekend, according to sheriff's office observations.

On the ATV Mud Nationals Web site forum, a representative from event sponsor High Lifter Products discouraged speculative posts about the accident.

"We are shocked and saddened by what has happened," the site reads. "Out of respect for the man's family we will not tolerate any speculation/discussion about it here.

"Posts of this nature regarding this topic will be deleted.

"Our thoughts and best wishes are with his family."

The sheriff's office is investigating the accident.

I think I saw ..maybe 3 cops..the whole time I was there... and they were only directing traffic.... They would need the National Guard to police that madhouse....

Who in these instances were negligent?

I would think that if an adult chooses to get on an atv and hurts himself/herself, he/she should be responsible for his/her own actions. Now, if you have someone that is breaking the rules, for example, riding while intoxicated, and that person injures someone else, that person should be held liable, and possibly the park for not enforcing rules. Now, with the waivers signed by each indiviuals, I am not even sure it would be right to sue the park?? Of corse, you could, but is it right?? People that attend Mud Nats know there will be a lot of people. You know there will be alcohol and you choose to attend anyway. If you did not know it beofre you got there, I am sure you are aware before you get unloaded. I think there needs to be personal responsibilty for your own actions.

As far as addition deaths, I have not heard about anything other than Sam's accident. There has been nothing in thge local papers that I can find and nothing on the local news.

I found only the one accident reported in East Texas media myself, Greg Sims.

While there's no evidence a helmet would have saved the victim's life, chances are a helmet would not have contributed to his death. The autopsy should disclose the cause of death; most usually, head inury in ATV fatalities.

What are the odds he wore a helmet?

What percentage of the non-competitive riders you observed wore helmets at the Mud Nationals, Voodoo?

I watched a video last night. I saw just what I have seen in the past. I did not see anyone in the video with a helmet. The truth is that most people attending mud rides like this just putt around at very low speeds. They spend most of their time sitting and watching. But, there are always a few that view these large gatherings as an opportunity to get rowdy and show off.

I have not heard whether or not a helmet was in use.

I am first in line to respect freedom and having some fun, redneck stuff etc.. But those events even worry me. I attended the Texas Redneck Games and Mud Stock last year. I put my tent in the bed of the truck. I figured I would get run over in my sleep on the ground. The police arrested 57 drunks at the Redneck Games. People got absolutely smashed and had no sense at all. It was almost not enjoyable due to the high dummy danger factor.

I would not want to ride in an environment like that myself. I dont know, maybe its because there is very little riding areas there that when someone opens up a stretch of land folks just go hog wild.
